Manufacturing determines a country’s comprehensive strength and international competitiveness. It is the lifeline of my country’s economy and the foundation of a country. At present, my country is focusing on building a modern industrial system with advanced manufacturing as the backbone. In order to achieve the optimal allocation of resources and maximize efficiency, more and more manufacturing companies are going abroad with their strong technical capabilities, participating in international competition and making global layouts.
As an important part of advanced manufacturing, excavator remanufacturing is a series of technical measures or engineering activities that are guided by the design and management of the whole life cycle of the machine, aiming to improve the performance of waste machines, and using advanced technology and industrialization methods to repair and transform excavators that are about to be scrapped.
The quality and characteristics of remanufactured excavators are generally not lower than those of new products, but the cost is only 50% of that of new products, and energy and materials are saved by 60%, 70%, and the emission of atmospheric pollutants can be reduced by more than 80% during the remanufacturing process.
At present, Chinese companies have a large number of second-hand excavator equipment, and there is a strong demand for such second-hand equipment in Africa, Southeast Asia, South America and other places, and the price continues to rise. In order to accelerate the cultivation of new foreign trade momentum, my country’s excavator remanufacturing industry is developing rapidly, and leading domestic excavator manufacturing companies are stepping up their layout. Some companies are committed to building an excavator remanufacturing industry cluster and becoming the leading industry standard setter; some companies are deploying excavator remanufacturing in multiple locations across the country; some companies regard remanufacturing as the core content of “value chain construction”, one of the four strategic options for aftermarket business; some companies focus on improving the excavator remanufacturing service system, and so on.
At present, my country is accelerating the promotion of excavator remanufacturing quality upgrades, giving full play to the advantages of a major excavator manufacturing country, accelerating the promotion of excavator remanufacturing exports, and constantly cultivating new foreign trade momentum in the manufacturing industry such as excavators. At the same time, the world today is undergoing a major change that has not been seen in a century, and the international landscape is undergoing complex and profound changes. Scientific and technological progress is changing with each passing day, the international financial crisis has far-reaching impacts, and new trends have emerged in the world economic landscape and international power comparison. Faced with a complex and sensitive international economic environment, my country’s excavator remanufacturing exports are also facing a series of challenges and risks.
First, the risk awareness and risk resistance capabilities of excavator remanufacturing export trading companies need to be improved, and guidance is urgently needed. Second, due to the lack of an effective evaluation mechanism, some unqualified excavators have entered the remanufacturing industry. Some of the process flows have not been standardized, and there is a lack of effective quality control. The quality of remanufactured excavator products is not very stable, and there are hidden dangers of trade disputes. Third, the relevant enterprises are not familiar with the market rules and legal systems of relevant overseas countries (regions), the collection of overseas market risk information is not comprehensive and accurate, and the risk assessment and early warning mechanism is not sound, so enterprises are prone to passiveness in the remanufacturing export trade of excavators. Fourth, due to the late start of the remanufacturing export trade of excavators, my country’s voice in this field is limited, and the existing international legal rules for the remanufacturing export trade of excavators are not conducive to the rapid development of my country’s remanufacturing exports of excavators.
Unfamiliar overseas markets, unfamiliar language and culture, different legal systems and trade rules, etc., are all obstacles that excavator remanufacturing enterprises must overcome when going abroad to participate in international competition. In order to help Chinese manufacturing enterprises, including excavator remanufacturing, “go overseas” and quickly connect with overseas market demand, it is necessary to improve the three major overseas risk prevention and control systems.
Improve the overseas risk prevention and control self-protection system
At present, the international environment is complex and severe. In this context, my country’s excavator remanufacturing exports need to further improve their own overseas risk prevention and control guarantee system.
First, all enterprises should work hard to improve their internal strength, establish and improve standardized remanufacturing process and effective quality control system, and ensure the quality of remanufactured products.
Second, strengthen the main responsible department for legal risk prevention and control, improve the overseas legal risk prevention and control work system, and deploy legal staff in the field of foreign-related excavators in a targeted manner.
Third, strengthen the comprehensive research on the relevant market rules and legal systems of the target countries (regions), clarify the legal risk points and actively avoid them, and take the initiative in risk prevention.
Fourth, strengthen the risk assessment of export behavior, guide and train risk prevention and control departments and staff to make correct decisions and respond effectively, do a good job in early warning and prevention, and minimize risks.
Fifth, improve risk response capabilities, be good at learning and using the legal system and rules of international trade in excavators, actively handle risks in an emergency, and do not fight in a chaotic manner and respond in an orderly manner.
Sixth, enhance the awareness of choosing to apply Chinese law and increase the predictability of case results.
Improve the policy support system for overseas risk prevention and control
At present, my country’s excavator remanufacturing industry is developing in different states in various places. To better protect the rights and interests of export enterprises, the policy support system for overseas risk prevention and control can be improved from four aspects.
First, benchmark international rules to guide the establishment of national (international) standards for excavator remanufacturing. In view of the current situation that enterprises have little technical accumulation and lack relevant standards, promote institutional opening such as rules, management, and standards, and establish a relatively systematic excavator remanufacturing process and quality standards. At the same time, establish and improve the economic and trade cooperation promotion system with Africa and the Regional Comprehensive Economic Partnership Agreement (RCEP) industry docking system, make full use of opportunities such as the joint construction of the “Belt and Road”, RCEP, and the African Continental Free Trade Area (AfCFTA), and create a national excavator remanufacturing export platform. Actively lead and supervise relevant enterprises to benchmark and standardize production and operation behaviors, and try to reduce unnecessary risks in foreign trade.
Second, improve the overseas risk information collection mechanism. Relevant institutions can comprehensively and accurately collect overseas market risk information, analyze and organize it in a timely manner, and publish it in a unified manner for export, so that Chinese enterprises can form a pre-understanding and accurate prediction of the risks of target countries (regions) and avoid overseas risks in a timely manner.
Third, improve the overseas legal risk assessment and early warning mechanism. In view of the legal risk factors that Chinese excavator remanufacturing enterprises may face in target countries (regions), establish a scientific legal risk assessment and early warning mechanism. Relevant departments can timely conduct a comprehensive assessment of the laws and policies of the main target countries (regions), and timely warn of countries (regions) where risks are more likely to occur.
Fourth, improve the overseas legal risk response and disposal mechanism. Strengthen training, guidance and support for emergency disposal of legal risks of relevant enterprises, rely on our official communication channels for mediation, use international sister city cooperation relations to smooth dispute prevention and control and communication channels, and improve the working mechanism for relevant departments to take the lead in coordinating with all parties to deal with complex situations. For major risk countries (regions), cultivate and establish an overseas legal risk response and disposal expert database, provide more legal assistance to Chinese companies involved, and improve the scientificity and initiative of disposal.
Improve the international protection system for overseas risk prevention and control
In the process of continuously promoting high-level opening up, we should actively lead and expand the international protection system for overseas risk prevention and control, and maximize the protection of the legitimate rights and interests of relevant Chinese companies under the rules of international law.
First, make full use of national bilateral treaties. There are many countries that have signed bilateral treaties with my country. We should make full use of this advantage. Under the expanding mutual trust and mutual benefit bilateral treaty trade and investment protection system, we should actively seek special cooperation in excavator remanufacturing export trade with target countries (regions) such as Africa, Southeast Asia, and South America, and promote greater achievements in my country’s excavator remanufacturing export trade.
The second is to actively create an international business environment. We should make full use of international cooperation practice platforms such as the joint construction of the “Belt and Road”, RCEP, and the China-Africa Economic and Trade Expo, and take the concept of building a community with a shared future for mankind as the guidance, coordinate and integrate foreign affairs resources, deepen friendly city cooperation, and widely build platforms for good cooperation with countries in the region and the world, so as to create a safer and more harmonious international business environment for my country’s export-oriented enterprises and prevent overseas risks from the source.
The third is to help expand my country’s voice in excavator remanufacturing exports. We will continue to actively participate in promoting the institutional and mechanism building of international platforms such as the Shanghai Cooperation Organization, BRICS, and the G20, put forward China’s concerns and suggestions in the fields of economic trade, investment development, human rights protection, dispute mediation, etc. within the framework of multilateral (bilateral) treaties, expand my country’s voice in the field of excavator remanufacturing and export, and contribute wisdom to the construction of fair and reasonable new international legal rules.
